Hemant Singh is an IP litigator, founder and managing partner of IP law firm Inttl Advocare with offices in Delhi and Mumbai. He is also a registered patent agent. He was admitted to the Bar in 1984 and handled over 2,500 IP litigations in various courts around India, involving contentious and complex issues. These include claim construction and coverage vis-à-vis disclosure, inventive step and test of obviousness in the field of patents; concept of prior use vis-à-vis overseas brand owner and Indian prior user; trademark usage vis-à-vis fair use in the field of trademark infringement including the use of trademarks by ancillary industry and in comparative advertising; protection of shape marks, exclusion of functional and utilitarian shape as a trademark; injunction against parallel import of goods; estoppel in respect of prosecution history of trademarks, patents etc. His specialisation includes trademarks, patents, designs, copyright, trade secrets, geographical indications, competition laws, IT laws, etc. With worldwide diverse clientele, he represents several Fortune 100 and 500 companies in the field of pharmaceuticals, foods and beverages, liquor, garments, cosmetics, FMCG, fashion accessories, computer software, telecommunications, media, electronics, automobiles, biotechnology etc.
He has been actively participating in the growth of valuable jurisprudence in the field of IP through various amicus briefs as well as through leadership of IP committees at international IP associations globally. He represents INTA as counsel in their first ever amicus brief before the Supreme Court of India in the case involving a parallel Import issue. Under his leadership, Inttl Advocare has won the Asia IP Awards in the category of Trademark Firm of the Year 2017, Best Trade Mark Counsel – Global Award 2014 by Novartis Pharmaceuticals, and ranked as a leading IP law firm by several global IP publications.
Hemant is a president of the AIPPI (International Association for the Protection of Intellectual Property) – India Group. He has served on the board of directors of INTA, also as the chair of INTA ACC South Asia Subcommittee and Co-Chair of INTA India Global Advisory Council. He continues to be a council member of the APAA (Asian Patent Attorneys Association) and a member of the enforcement committees of the AIPPI and INTA as well as a member of Marques.
