Samsung Electronics is to appeal a 3 October ruling by Delhi High Court that allows the import of its printers into India without the consent of its Indian subsidiary, which is the registered proprietor of its trademark in the country.
“Samsung is preferring an appeal to Supreme Court,” said Pravin Anand, managing partner of Anand and Anand, who represented Samsung at Delhi High Court along with Nischal Anand, a senior associate at the firm.
The Korean electronics giant suffered a setback when a division bench of Delhi High Court set aside part of a 17 February ruling by a single judge of the same court that had restrained Kapil Wadhwa, a former authorized dealer of Samsung, from importing, exporting and dealing in printers, ink cartridges and toners bearing the company’s trademark.
