Delhi High Court has permitted Aloys Wobben, the founder of Enercon, to withdraw three appeals he had filed challenging the revocation of his patents by the Intellectual Property Appellate Board (IPAB) in Chennai (Madras).
The IPAB revoked 12 patents owned by Wobben in November and December 2010 following an application by Enercon India, a joint venture company in which Wobben himself is the majority shareholder (see Mutiny in the Boardroom, IBLJ, volume 4, issue 10).
Wobben responded by filing appeals against nine of the revocations in Madras High Court and the remaining three in Delhi High Court, where litigation relating to those patents was already taking place.
