Bombay High Court has ruled that aircraft owners are not liable to pay charges for the use of airport facilities provided by the Airport Authority of India (AAI), unless a contract between the aircraft owner and AAI has been signed.
The judgment came in a dispute between Aer Lingus, the Irish flag carrier, and the AAI.
Aer Lingus had leased two of its aircraft to Mumbai-based East West Travels & Trade Links for air-taxi operations in India. East West was expected to pay for services provided by the AAI to in relation to the two aircraft. However, the payments were not made.
