New competition law in effect in the Philippines

The Philippine Competition Act (PCA) went into effect on 5 August 2015. Its implementing rules and regulations became effective on 18 June 2016. The law applies to acts committed in the Philippines and those done offshore that have direct, substantial and reasonably foreseeable effects in the country.

The implementing authority for the new law is the Philippine Competition Commission (PCC). The PCC has original and primary jurisdiction to enforce and implement the law, even with respect to entities that are under the regulatory jurisdiction of specialized government agencies. It has the power to stop a merger or acquisition, issue divestiture and adjustment orders, impose administrative fines, and deputize government agencies and enlist their assistance, as well as that of private institutions, to implement the law.

Its orders, rulings or decisions are immediately executory, unless otherwise restrained by the Court of Appeals or the Supreme Court.
