Madras High Court protects actor’s personality rights

Madras High Court granted an injunction to restrain the makers of the film Main Hoon Rajinikanth from using actor Rajinikanth’s name, caricature, style and image to prevent the infringement of his personality rights.

Main_Hoon_Rajinikanth_film_posterIn Shivaji Rao Gaikwad (Rajinikanth) v Varsha Productions, the court observed that a celebrity is entitled to an injunction against anyone who uses their name without their permission. The courts have recognized that personality rights rest with those who have attained celebrity status even though India has no law that defines personality rights.
