The Madras High Court has directed the state government to “issue a notification for the inauguration” of an intellectual property division within the court, following delays in the process.

The delay has worsened the situation for several litigants who remained remediless after the abolition of the Intellectual Property Appellate Board. The abolished board’s matters are to be transferred to the high court. Draft rules were formulated by an IP committee set up by the Chief Justice of the Madras High Court and approved by the Full Court. However, despite reminders, the state government has not yet notified the rules.

The high court has now given the government one week to issue the notification.

The matter was initially listed on 22 February 2023, but was postponed to 1 March 2023.
