Experience, charm and the art of satisfactory mediation

How do you help relevant parties find satisfactory mediation solutions? And further, how do you have the relevant parties happily and willingly accept solutions proposed by mediators? Do you simply rely on the personal charms of your mediators? These were some questions put to mediators at a recent seminar put on at the Beijing Arbitration Commission’s (BAC) Mediation Centre.

BACLet’s take a dispute related to a financial intermediary once handled by the BAC Mediation Centre as an example. In this case, due to the parties’ failure to get a document required for administrative review notarised, an ambitious expansion plan worth hundreds of millions of renminbi was shelved. When the case was referred to the centre, the expansion plan had already been shelved for several months, and the best window period in the market had long passed.
