Can the Copyright Board pass interim orders in proceedings under section 31 of the Copyright Act, 1957? Allowing an appeal in Music Broadcast Pvt Ltd v Super Cassette Industries Ltd, a two-member bench of Delhi High Court recently held that if interim relief is not granted, “the immediate and direct consequence will be the complete frustration of the rights under section 31 of the act”. As such, it remanded the matter back to the Copyright Board for passing interim orders. Section 31 provides for the grant of a compulsory licence in respect of copyrighted works.
