Composer awarded US$5m in copyright case

In a landmark copyright case, Mumbai-based composer Ram Sampath won a petition in Bombay High Court against Filmkraft, a company owned by Bollywood filmmaker Rakesh Roshan.

The court ruled in April that the filmmaker should pay Sampath US$5 million for copyright infringement. Sampath had filed a suit claiming that two tracks and two remixes that were used in Roshan’s film Krazzy 4, released in April, were taken from music he had composed for a Sony Ericsson mobile advert.

Justice DG Karnik found Roshan and his brother, soundtrack composer Rajesh Roshan, guilty of copyright violations and plagiarism. “To my untrained ear, the music appeared to be similar,” Karnik said. An attempt to prevent the film’s release was dismissed after Filmkraft agreed to pay Sampath damages and give due credit.
