The classification of goods and services in the Trade Mark Rules, 2002, was amended to bring it in line with the Nice Classification used by the World Intellectual Property Organization (WIPO). The amendment, which came into effect on 20 May, expands the lists of services for which a trademark can be registered.

India follows the international classification of goods and services laid down by the Nice Agreement, which is incorporated in the Fourth Schedule to the Trade Marks Rules, 2002. As in the Nice Classification, the goods and services listed in the Fourth Schedule are divided into classes. While the first 34 classes relate to goods for which a trademark can be registered, classes 35 onwards cover services.

The amendment modifies class 42 and also adds three classes of services. The expanded list of classes now includes:

42: Scientific and technological services and research and design relating thereto; industrial analysis and research services; design and development of computer hardware and software.
