Nepotism – the act of awarding jobs, privileges and favours to family members – is a time-honoured tradition in India. However, its increasing exposure in the higher judiciary is wreaking havoc on India’s already widely-questioned legal system and rooting nepotism out is proving difficult.
The issue of judicial nepotism surfaces repeatedly – especially in state high courts.
Unusually, in 2006, it reached all the way up to the Supreme Court and its highest office holder. Former Chief Justice YK Sabharwal has been accused of favouring his property developer sons Chetan Sabharwal and Nitin Sabharwal by passing an order to shut down properties used for commercial purposes in Delhi’s residential zones.
