Enrico B Astudillo had extensive practice in all aspects of commercial law in the Philippines before he specialised in the practice of IP law in 1984. He is an experienced commercial litigation attorney. His practice encompasses all aspects of commercial relationships and transactions.

Astudillo represents major multinational corporations in a variety of industries in opposition, cancellation, infringement, unfair competition and counterfeiting cases before the courts and the Intellectual Property Office (IPO). He has vast experience in all phases of patent and trademark prosecution, including the preparation of clearance and availability opinions, as well as appeals within the IPO and before the Court of Appeals and the Supreme Court of the Philippines.

Astudillo represents major multinational clients in the pharmaceutical, agricultural, automotive and chemical industries in patent and trademark prosecution and the enforcement of their rights in the Philippines. He has guided a major pharmaceutical client on the significant ramifications on pharmaceutical patent rights of the landmark Cheaper Medicines Act in the Philippines.

Astudillo regularly attends international conventions to keep abreast of developments in IP. He is a member of the American Bar Association and its IP law and international law sections. He is also an active member of the International Trademark Association, the Pharmaceutical Trademarks Group, the Licensing Executives Society International, the Association Internationale Pour La Protection de la Propriete Industrielle, and the Asian Patent Attorneys Association.

Astudillo earned his bachelor of arts degree in 1974 and bachelor of laws (LLB) degree in 1980 both from the University of the Philippines. He placed 20th in the Bar Examinations of 1980. He attended law school in the evening while working full-time for Procter & Gamble Philippines during the day.

Patricia Bunye heads Cruz Marcelo & Tenefrancia’s mining, natural resources department and energy practice group, and is also a partner in its IP department. Avelino Cruz Jr is a senior partner specializing in commercial litigation, corporate and commercial law, infrastructure projects, and administrative law. He previously served as secretary of the Department of National Defence, where he brought a fresh civilian perspective to address the challenges faced by our country’s defence and military establishments. He was widely credited for introducing fundamental, comprehensive, and institution-wide reforms through the Philippine Defence Reform program. His unblemished stint in public service and record of success in the defence department have become benchmarks upon which others who followed have been measured. Some of the groundbreaking reform initiatives started by his leadership have become the foundation of wide-ranging public sector reforms currently being undertaken.

He was admitted to the New York Bar in 1991 and was a bar examiner in commercial law in the 1995 Philippine Bar Examinations. Cruz served as president of the Philippine Bar Association. He is also a member of prestigious international lawyers’ organisations, such as the Asean Law Association, International Bar Association, Inter-Pacific Bar Association, and the New York State Bar Association. In 2003, he was conferred a doctor of laws degree honoris causa by the Baguio Colleges Foundation.

Cruz graduated cum laude and salutatorian from the University of the Philippines College of Law in 1977 and placed 7th in the bar examinations. As a student leader during martial law, he served as president of the University of the Philippines Law Student Government and the Student Council of the Ateneo de Manila University, where he earned his bachelor of science degree in mathematics.

Enrique V Dela Cruz Jr is a senior partner and data protection officer at DivinaLaw. He is also the head of the firm’s arbitration, data privacy, IP and fintech groups. Estrella C Elamparo is a seasoned litigator with more than 25 years of experience in various areas of litigation and has handled many high-profile cases. The managing partner of the firm, Roderico Puno, graduated from the Ateneo de Manila University College of Arts and Sciences with a degree in political science in 1985, and a Bachelor of laws degree from the same university in 1989. He obtained his master of laws (with honors) from Northwestern University School of Law in Chicago Illinois and was admitted as a partner in the firm in 1995.

From 2001 to 2003, Puno served as vice president-legal for First Philippine Holdings Corporation, a conglomerate engaged in power distribution, power generation, manufacturing, and real estate development. He was included in a team that handled the USD500 million debt restructuring of the parent corporation and other affiliates, being in charge of the Philippine law aspects of the deal. From 2006 to 2014, Puno served as Director of Global Business Power, the power investment arm of the Metrobank/Ty Group, and from 2011-2017, he served as director of GT Capital Holdings, the listed holding company of all the interests of the Ty family in Metrobank, Federal Land, Toyota, and other affiliates of the group.

Puno served as corporate secretary of BDO Private Bank from 2004 to 2012, BDO Securities Corporation from 2011 to 2012, Atlas Consolidated and Mining and Development Corporation from 2006 to 2021, and First Philippine Industrial Park from 1996 to 2018. From 2012 to 2014, he served as assistant corporate secretary of Metropolitan Bank and Trust Company.

Puno currently specialises in energy law, corporation law, banking, project finance, real estate, utilities regulation, privatisation, securities, and infrastructure project development. He is leading authority on Philippine energy law practice, having been in the technical working group of the Committee on Energy of the Philippine Congress, representing the private sector that drafted the Electric Power Industry Reform Act, the primary law governing the energy industry in the Philippines. Puno has been engaged as a public-private partnership (PPP) key legal expert of the Philippine Public-Private Partnership Centre and the Department of Public Works and Highways in connection with the bidding for the development and operation of an expressway-dike project.

Joseph Rebano joined Del Rosario & Del Rosario in 1996 and currently heads the firm’s marine casualty practice. Joseph has a broad maritime focused practice. Joe Nathan Tenefrancia is Cruz Marcelo & Tenefrancia’s (CMT) managing partner and head of its telecommunications and information and communications technology group. Pancho Umali is a senior partner in Cruz Marcelo & Tenefrancia’s corporate and commercial law department and mining and natural resources department.

Susan D Villanueva is an experienced and accomplished litigator who has successfully represented IP, tax and trade cases.

Villanueva heads the firm’s IP department and is the principal litigator of IP litigation and enforcement cases. She was the principal litigator of landmark IP cases in the Philippines where the Supreme Court first declared a trademark as internationally well-known and affirmed the jurisdiction of the IP Office over administrative cases for violations of IP rights. She also successfully defended before the Supreme Court search warrants issued against suspected infringers in an enforcement action for the liquefied petroleum gasoline industry. She successfully argued before the Supreme Court to affirm the abandonment of a patent on the ground of public interest.

Villanueva is also a lead litigator of the tax litigation group with extensive experience handling cases before the court of tax appeals and appellate courts. Villanueva is the principal advisor and lead litigator of a major petroleum company on major tax litigation matters.

She also heads the firm’s trade practice group. She represented the Philippine cement industry in obtaining the first provisional safeguard measure issued in the Philippines. She has also advised the petrochemical industry on Asean Free Trade Agreement (AFTA) matters.
