The Supreme People’s Court (SPC) has clarified the jurisdiction over arbitration cases for China International Economic and Trade Arbitration Commission (CIETAC) and its two former subcommissions in Shanghai and Shenzhen.
The SPC guidance is provided in the Reply to the Request of Shanghai Municipal Higher People’s Court and Other Courts for Instruction on the Judicial Review Cases Concerning the Arbitral Awards Made by the Arbitral Institutions Including China International Economic and Trade Arbitration Commission and Its Former Subcommissions.
The reply took effect on 17 July, and provides a practical solution for handling arbitrations which have chosen CIETAC’s previous subcommissions.
