On 1 July, the National People’s Congress standing committee’s amendments regarding the Labour Contract Law, passed in December, will come into effect with a direct impact on an estimated 37 million workers in China. At the core of the amendments are regulations that apply to dispatch personnel, temporary workers hired by companies through agencies called dispatch service providers.

To begin with, there are new requirements regarding these agencies – their establishment, qualifications and licence requirements. Certain inequalities are also addressed, for example the equal pay concept for dispatch personnel and a company’s full-time, direct-hire staff that perform the same functions. Job descriptions for dispatch personnel are also explored, and more concise definitions for various types of dispatch work are identified. Importantly, the legal liability of both dispatch provider and client company have been increased for breach of regulations.
