Authorities are seeking comments on a draft revision to the Competition Commission of India (Commitment) Regulations, 2024, which proposes changes to address procedural issues in the current rules on entities accused of anti-competitive practices.
The regulations allow an entity under investigation for anti-competitive practices to offer assurances or commitments to the the Competition Commission of India (CCI) that they will take corrective measures.
These assurances are submitted in a commitment application under the regulations. The draft addresses procedural issues, including the timelines on the commitment application, rectification of defects in applications, and clarifying the adjustment of fees and consequences of invalid applications.
The draft proposes that an entity has 60 days, instead of the current 45 days, to file an application from the date of the investigation order.
The proposed changes also provide that when defects are found in the application, it will be returned to the applicant with all the defects marked. The applicant then has 10 days to refile it with all the defects addressed, and the fees paid for the initial filing shall be adjusted towards the rectified submission.
When the applicant does not rectify the defects, their application shall be deemed invalid.
Under the proposed procedural timeline changes, applications must be filed within 15 days. Currently, the applications are required to be filed within seven days. It is also proposed that proceedings are concluded within 180 days, revised from 130 days, and can be extended when appropriate.
Comments must be submitted by 29 June 2026.
