 China-Business-Law-Journal-Issue-2 CoverIn this issue we look at the challenges facing Chinese companies investing in the developed economies of Europe, North America and Australia. “Same bed, different dreams” was the old cliché used to describe Sino-foreign joint ventures and the often wildly divergent expectations of the two sides. Now that hackneyed phrase can be applied to many Chinese investors venturing overseas. Getting advice from the right lawyers, and taking full account of the cultural and political challenges waiting on the other side of the four seas, will be key to the success of corporate China’s outbound adventures.

Closer to home we examine the new measures on foreign-invested partnerships, which take effect on 1 March. The article reflects a range of viewpoints among lawyers about the impact the measures may have. For venture capital and private equity investors, law and practice are changing rapidly. More broadly, for foreign investors and their Chinese partners, the measures seem to introduce a new structure for foreign investment – one that appears not to need MOFCOM approval. Is it really the case?

Our third feature article offers a summary and analysis of the ChiNext listing rules. ChiNext offers a new route to funding for small and high-growth companies.

And finally we introduce an essential addition to the toolkit of any practitioner assisting in cross-border transactions – Lexicon. The challenges facing in-house counsel and lawyers doing international business in at least two languages are daunting. The Lexicon will focus on questions of law and language, and how to jump the linguistic hurdles we all encounter in the exciting – and honourable – field of international interchange we have chosen.
