India’s Ministry of Law and Justice has introduced a National Litigation Policy (NLP) in an effort to reduce the number of cases pending in courts across the country. The NLP is intended to bring the average pendency of cases down from 15 years to just three years.
The NLP document acknowledges that the Indian government and its various agencies are the predominant litigants in courts and tribunals across the country. It therefore proposes to “reduce government litigation in courts so that valuable court time would be spent in resolving other pending cases”.
The policy encourages the elimination of bottlenecks, many of which have been associated with the government and its agencies, and the removal of unnecessary government cases.
