The Supreme Court of India has ruled that section 66A of the Information Technology Act, 2000, is unconstitutional and should be struck down.
Section 66A relates to punishment for sending offensive messages by e-mail, phone, or other communication devices. This covers messages which have “a menacing character” or are sent “for the purpose of causing annoyance, inconvenience, danger, obstruction, insult, injury, criminal intimidation, enmity, hatred or ill will”.
