Jet in legal tangle over staff layoffs

Jet Airways almost found itself in the courts in October after it laid off 800 employees, and announced plans to get rid of a further 1,100.

Earlier in the month, Jet signed an agreement with Kingfisher Airlines to help battle rising costs and rationalize operations. Shortly after the deal was signed, Jet, under the leadership of chairman Naresh Goyal, announced a major layoff of employees across the country. The storm of protest that followed caused the airline to reverse its decision.

According to legal observers, the airline had failed to follow the law, as laid out in the Industrial Disputes Act,1947, which governs the process for laying off staff. Under the act, employees who have completed their probationary period may approach the labour commissioner to seek justice for undue removal from service. Jet allegedly failed to provide proper reasons for the dismissal, such as misconduct, closure of operations or huge company losses.
