Introduction

Robin Darton is a partner and head of the restructuring and insolvency practice at Tanner De Witt. With almost three decades’ experience, Robin has built a reputation as one of the most prominent and well-respected lawyers, and is consistently ranked as a “Leading Lawyer” for restructuring and insolvency in Hong Kong by various publications.

Throughout his career, Robin has focused on litigation and other contentious issues across a wide range of subjects, with a particular emphasis on contentious insolvency and restructuring matters. He advises insolvency practitioners, private equity and distressed funds, asset managers and debtors on a range of issues, with an emphasis on restructuring and insolvency matters.

His experience includes: acting in domestic and cross-border winding-up proceedings; bond restructurings; bankruptcy matters; court-related aspects of creditors’ schemes of arrangement; appointments of provisional liquidators; cross-border recognition proceedings; claims against directors and auditors; fraud and asset tracing; enforcement of security and debt recovery.

Robin has also advised on some of Asia’s highest-profile insolvencies and restructurings over the past two decades, including Lehman Brothers, Akai, Brook Brothers, MF Global, China City Construction (International) and Kaisa, as well as projects for China Cinda.

Robin also has extensive experience acting in banking litigation matters, with a focus on financial transactions disputes. He is well-versed in dealing with offshore considerations, regularly utilising his strong and well-established relationships with offshore qualified lawyers, particularly those from the Cayman Islands, British Virgin Islands, Channel Islands and Bermuda, which further strengthen his position as a leading figure in the field. Many of his matters also involve cross-border elements in Mainland China, where he works closely with Mandarin-speaking members of the team.
