Introduction

Since starting in 1993, David Jia Hongwei has been engaged in commercial legal practice closely linked to corporate finance. Jia was among the earliest lawyers to engage in enterprise bankruptcy and liquidation in China, and has garnered a lot of achievements and practical experience in this field.

Soon after returning from studies in the US, he represented many Chinese manufacturers responding to anti-dumping and anti-subsidy investigations initiated by the US, the EU, India, Canada, Turkey and other countries against China. He also became one of the earliest lawyers to engage in anti-dumping investigations in South China. Based on this experience, he co-wrote a book titled, The Legal Practice in Responding to Foreign Anti-dumping Investigations. In addition, Jia has accumulated a lot of experience and skills in matters related to foreign direct investments, mergers and acquisitions, foreign-related civil and commercial litigations, etc.

Based on his years of international legal practice background, Jia was appointed as arbitrator by the Shenzhen Court of International Arbitration (SCIA), Hainan International Arbitration Court (HIAC), Nanjing Arbitration Commission (NJAC), Harbin Arbitration Commission (HBAC) and Asian International Arbitration Centre (AIAC), focusing on international disputes resolution.

Jia has heard many international arbitration cases, either as a presiding arbitrator or as a sole arbitrator, rendered expert reports for the Hong Kong High Court, the US courts, as well as ICC arbitral tribunals, as the party-appointed expert.

For his work, he was selected as one of 40 participants by ICC Advanced Arbitration Academy for Asia (2018-2020). His articles – titled “Seat: The Short Board of Chinese Arbitration Law 1994” and “Ad Hoc Arbitration: The Absence of Chinese Arbitration Law 1994”, and “Interim Measures: The Important Way for Chinese Arbitration’s Internationalisation” – have attracted strong attention from professionals, and also won many awards.

Jia obtained an LLB from Peking University Law School, a Master degree of economics from Peking University School of World Economy, and an LLM from American University’s Washington College of Law. He is a member of the Leading International Professional Pool in China, Guangdong and Shenzhen, and was selected as one of the 1,000 International Professionals (2018) by the Ministry of Justice.

His other relevant qualifications and honorary titles are: Director of China Academy of Arbitration Law; mediator of Commercial Mediation Centre of China International Commercial Chamber; specialist mediator of Singapore International Mediation Centre; independent director qualification for Listing Corporation in China Stock Exchanges; legal assistant to the Standing Committee of Shenzhen Municipal People’s Congress; Outstanding Professional Lawyer in Shenzhen; standing director of Guangdong Lawyers Association; chairman of foreign affairs committee of Guangdong Lawyers Association Belt and Road Commission; Ambassador of ICC International Court of Arbitration.
