Introduction

Feng Yao worked in the Ministry of Commerce’s (MOFCOM) Department of Treaty and Law as a governmental counsel from 1997-1999, and then as director of the Anti-Dumping Office from 1999-2001. She worked at Covington & Burling’s Washington DC office from 2002-2003, and in 2014 joined Broad & Bright as one of the firm’s founding members. In 2019, she joined Sunland Law as principal leader of the Hong Kong office.

Feng focuses on antitrust law, international trade and FDI areas in her practice. She has served as attorney for hundreds of filings to the State Administration for Market Regulation (SAMR) and MOFCOM regarding concentration of undertakings, and has provided legal services in various international trade disputes for companies and government agencies in China, South Korea, Japan, the US, EU and Russia. She also has rich experience in the areas of customs affairs, WTO, international trade disputes and FDI.

Feng has served as attorney for many significant deals, and has rich experience in competition law. Since 1 August 2008, MOFCOM/SAMR have cleared more than 3,300 fillings to date, out of which the team has represented hundreds, being one of the domestic firms that has handled the most cases in China. Feng has been ranked a Band 1 lawyer in the industry by Chambers for 12 consecutive years, since 2008. Her high-quality service has won recognition from clients and legal professionals, and she has won many awards from prestigious legal ranking publications. These major awards include: Chambers Asia-Pacific: Asia’s Leading Lawyer in Competition/Antitrust 2019; and GCR 100 – 19th Edition – Antitrust. In 2018, Feng won Chambers and Partners: Yao Feng – Leading Lawyer in Competition/Antitrust (PRC Firms) Band 1, 2018.

In addition to merger reviews, Feng and her team have provided consulting services for various antitrust issues including representing clients on dealing with National Development and Reform Commission investigations. Feng and her team also have extensive experience in providing consulting services to international companies for antitrust compliance issues under the Anti-Monopoly Law.
