Introduction

David Lin has a comprehensive educational background in engineering and law. His business areas include patents, copyrights, trade secrets, unfair competition, and technology, media & telecom. Lin was the leading attorney defending Sinovel in actions brought by American Superconductor for copyright infringement and trade secret misappropriation, in which the claimed damages (RMB3 billion) are to date the highest in IP litigation between China and the US.

Lin provides intellectual property services for well-known internet and high-tech enterprises such as Samsung, ZTE, Xiaomi, Meituan, Youku and, Kingsoft. He has also provided comprehensive intellectual property services for the Ministry of Transport, Tsinghua University, Qilu Pharmaceutical, YRPG, Evergrande Real Estate, and Ping An Groups, and other national ministries and large commercial institutions.

In 2008, Lin represented the copyright infringement dispute of the “Struggle” TV series, which became a typical case of the “red flag standard” in an infringement case of information network dissemination rights; In 2009, he represented Tsinghua University in a well-known trademarks and unfair competition case, which was marked as a typical IP case by Beijing High People’s Court; In 2015, he represented Xiaomi in winning a case against Qihoo regarding jurisdiction objection, which was selected in the Annual Top Ten IP Creative Cases by Beijing courts; In 2018, the right of reputation dispute Xiaomi v Li was selected in the top 10 network typical cases of the reputation of the Haidian Court.

Lin was named as the outstanding young lawyer recommended by the China Legal Education and Career Seminar Series in 2017. In 2018, he was selected as the leading Chinese lawyer (Antitrust & Competition) by Legalband. He was also selected into “A-List – China’s Top 100 Lawyers of 2018” by the authoritative legal media China Business Law Journal. In 2019, Lin was selected as the top-ranked lawyer (Antitrust & Competition) in China by Legalband again, and the top IP lawyer in China by Zhichanli & IPR daily.
