Holding that “the state itself, or a state instrumentality cannot impose unconstitutional conditions in statutory rules/regulations vis-à-vis its employees”, a two-judge bench of the Supreme Court recently ruled that the hire and fire policy adopted by a public sector company violated the equal protection clause contained in article 14 of the constitution of India.
