The Competition Commission of India (CCI) has ruled in favour of Microsoft in a case launched against it by Singhania & Partners, a Delhi-based law firm.
Singhania & Partners filed a case against Microsoft with the CCI in November 2009. The law firm alleged that Microsoft was abusing its dominant position by compelling its agents in India to adopt differential pricing for sales of original equipment manufacturer (OEM) licences, volume licences and individual licences of its software. Singhania & Partners argued that the practice violated India’s competition rules, which prohibit manufacturers from imposing restrictions on the resale of their products.
However, in its ruling, the CCI stated that Singhania & Partners “has not been able to bring any cogent evidence on record to show that the opposite party [Microsoft] is abusing its dominant position in the relevant market”.
