Introduction

Ye Han is a partner of Merits & Tree Law Offices and in charge of the antitrust and competition department. Ye is also a member of the Competition and Anti-monopoly Committee of Beijing Lawyers Association.

Ye received his LLB from Shandong University and LLM from the Chinese University of Hong Kong. As one of the earliest lawyers practising antitrust law in China, Ye has all-round experience in the antitrust law area, including merger filing, antitrust self-examination and compliance, antitrust investigation, and antitrust litigation. For complicated cases, Ye not only has successful experience in negotiation, implementation and release of restrictive conditions, but also has successful applications of antitrust law to hostile M&A and anti-hostile M&A cases.

Ye has served many top companies from different jurisdictions. His practice experience covers industries such as semiconductor, technology media and telecoms (TMT), comprehensive health, fast moving consumer goods (FMCG), automotive and parts, telematics, commercial estates, maritime shipping, manufacturing, and entertainment.

His representative cases include but are not limited to: Advising Qualcomm on its National Development and Reform Commission (NDRC) antitrust investigation; providing full antitrust law services to ASE for its US$1.5 billion acquisition with SPIL, which won the Taiwan M&A Jinxin award; providing anti-hostile takeover services for IKang regarding Meinian’s acquisition; providing merger filing services for Komatsu’s US$2.9 billion acquisition of Joy Global; providing legal services for Media Tek and MStar on their joint application for removal of restrictive conditions attached through merger filing; and representing Jing Dong in suing a famous online retailers for abusing its dominant position in the market.

Ye has served the Ministry of Transport, China Resources, WPG, Sony, Nissan, GLP, Continental and other clients. He was highly praised not only by clients but also by co-operation law firms such as Cravath Swaine & Moore, Wachtell Lipton, and Nagashima Ohno & Tsunematsu.

Ye has been invited to deliver speeches in several important forums and platforms. He has also been invited to interview or comment on antitrust cases and newly published laws and regulations. He is also the exclusive writer of the LexisNexis antitrust compliance manual.
