Introduction

Ma Xiang, the senior partner of Tiantai Law Firm, is one of the earliest lawyers specializing in trademark field in China. Over the past 25 years, Ma has handled tens of thousands of domestic and foreign trademark applications, thousands of trademark opposition and review cases, and represented hundreds of administrative cases involving trademark authorization and confirmation. His representative cases include China’s first three-dimensional trademark application, China’s first trademark reverse passing-off case, and China’s first trademark non-infringement litigation. Ma is the vice director of the Intellectual Property Commission of the All China Lawyers Association (ACLA) and the founder of the Trademark Committee of the Beijing Lawyers Association (BLA). Ma is also an adjunct professor at the China University of Political Science and Law (CUPL) and the National Lawyer College, a researcher at the Intangible Asset Management Research Center of CUPL, an expert of the Expert Advisory Committee of the IPR Case Guidance Research (Beijing) Base of the Supreme Court, and a member of the Expert Committee of the Civil and Administrative Litigation Supervision Cases of the Supreme Procuratorate.

Representative Performance

Ma acted for Jiangsu Satellite TV in the IP retrial case in Guangdong Higher People’s Court. We successfully overturned the previous judgment and confirmed the non-infringement of the client. This case was selected as the Ten Model IP cases of the Supreme Court. Ma acted for Qing-Feng Steamed Dumpling Shop in the IP retrial case in the Supreme Court and successfully overturned the previous judgment. This case was selected as the Ten Model IP cases of the Supreme Court.
