Introduction

Bai Xiao has a comprehensive educational background with a bachelor’s degree in engineering from Tsinghua University, a JD from Chicago-Kent College of Law, and an LLM from the University of Chicago Law School, enabling her to integrate civil law and common law knowledge.

Bai is licensed to practise law in China and Illinois in the US. She worked at Barnes & Thornburg before practising at Zhong Wen Law Firm since 2011 in the areaof foreign-related business and dispute resolution. She served on the board of supervisors of Zhong Wen from 2020 to 2023, and has been a member of the firm’s executive committee since 2023.

Bai is not only well-versed in litigation and arbitration, but also specialises in mediation and negotiation. She has represented many large enterprises in resolving their foreign investment and trade disputes, has skillfully used English in international arbitration hearings, and has promoted the recognition and enforcement of foreign arbitral awards in China, Switzerland and other places.

Bai focuses on cross-border commercial solutions, serving as a perennial legal consultant for many large enterprises, providing all-round legal support for many foreign clients coming into China as well as outbound domestic clients. This includes designing corporate structures, identifying business partners, conducting due diligence investigations on international trade and cross-border investments, and the drafting and reviewing of contracts, articles of incorporation, and other relevant documents.

Some of Bai’s representative achievements in dispute resolution for foreign-related businesses are representing a Chinese environmental protection material company in a procurement contract dispute with a Swiss company at the Singapore International Arbitration Centre; representing a Chinese storage technology company in a distribution contract dispute with an Israeli network security technology company at the China International Economic and Trade Arbitration Commission Hong Kong Arbitration Center; and representing a Cayman Islands company, a Hong Kong company, two Chinese network technology companies, two British Virgin Islands companies, and two natural persons (a total of eight respondents) in an equity investment dispute with a BVI company at the Hong Kong International Arbitration Centre.

Her notable non-litigation achievements include a cooperative factory construction project between a Chinese new-energy technology company and an American automobile manufacturing company; a Chinese maternity and children’s products company’s investment in a factory construction project in Malaysia; the acquisition of a Russian company by a Chinese-listed aviation firm; and a compliance project for a foreign zero-knowledge rollup technology start-up.
