Trusts and trustees as partners in limited liability partnerships

Through a circular dated 14 October, the Ministry of Corporate Affairs has clarified that a trust or a trustee representing a trust in the case of real estate investment trusts, infrastructure investment trusts or other trusts that are set up under the regulations prescribed under the Securities and Exchange Board of India Act, 1992, can become a partners in a limited liability partnership (LLP).
