The plaintiff is the applicant of the No. 49533182 “Haoxianglin” trademark, which was rejected due to its similarity to the No. 17599670 “Haoxianglin” trademark. In the rejection review procedure, the CNIPA still determined that the trademark in dispute and the cited trademark constituted similar trademarks used in similar services, and the registration of the trademark in dispute violated Article 30 of the Trademark Law. In the case, the agent actively took advantage of the fact that the owner of the cited trademark was cancelled, and finally successfully helped the party to remove the obstacle of prior rights, won the first-instance case, obtained the greatest rights and interests for the party, and avoided the burden of the second-instance lawsuit.
