Introduction

Mahesh Agarwal is the managing partner of Agarwal Law Associates (ALA), a full-service law firm, based in Delhi, pioneering in the field of dispute resolution in India. He has won several accolades from leading organisations for his contribution in the legal field.

With more than 29 years of extensive and highly regarded experience, Mahesh’s expertise ranges from disputes in the field of insolvency, arbitration, commercial, banking, intellectual property, corporate, criminal to regulatory disputes in the field of energy, mining, telecoms and others. His clients include top corporate groups including Fortune 500 companies who he represents across India. Mahesh is a third-generation lawyer and an alumnus of the prestigious Shri Ram College of Commerce and Government Law College, Mumbai.

In recent times Mahesh has represented the Future Group in its high-stakes arbitration against Amazon.com at the SIAC and related proceedings before the CCI, NCLAT, Delhi High Court and Supreme Court. He has also successfully represented Delhi Airport Metro Express against the DMRC in relation to its arbitral dispute. Mahesh has also represented big corporate houses, including Essar Bulk, Reliance Infrastructure, Dalmia Cements etc, in important arbitration cases.

ALA also handles litigation pertaining to arbitration, mining laws, the Electricity Act, the insolvency and bankruptcy code, taxation law, NGT and environment law and other commercial issues. He has successfully represented Delhi Airport Metro Express Private Limited (R-Infra) in upholding of an award of more than INR50 billion (USD611 million) against a PSU-DMRC and is contesting the execution proceedings with respect to the award. He is also representing promoters of Hero Motocorp in an arbitration dispute in relation to a family settlement agreement. He has also successfully represented Vidharbha Industries Power Limited before the Supreme Court in a landmark judgment on the interpretation of Section 7(5) of the IBC. He also successfully represented Adani Power before the Supreme Court on the issue of compensation amounting to around INR50 billion, due to changes in the law on account of the domestic coal shortfall.

Mahesh advises prestigious Indian companies and also handles assignments for state governments.
