Introduction

Pisut Rakwong is the founder and managing partner of Pisut & Partners. His main practice areas are dispute resolution, corporate, insolvency and restructuring, trade competition, labour and employment, insurance, administrative and white-collar criminal matters. Pisut also has extensive experience in Thai court proceedings and arbitrations under the ICC, THAC and TAI rules.

Pisut practices in all areas of commercial law with a particular emphasis on civil fraud, white-collar crime, shareholders and joint venture disputes, international trade, and employment. Pisut also has extensive experience in obtaining emergency and interim injunctions, including freezing orders. Many of Pisut’s cases involve multiple jurisdictions and the instructions to provide expert witness services in the foreign courts in connection with multi-jurisdictional claims related to Thailand.

In addition, Pisut has been admitted to the THAC Panels of Arbitrators, specifically as an arbitrator panellist for corporate, international trade, information technology, shareholders, joint venture disputes, and the general commercial panel.

Recent case highlights:

• Advising the unit owners and juristic person of Ashton Asoke on the potential or contingent risk of impact on the right over the properties following the judgment of the Central Administrative Court to set aside all governmental authorisations with respect to the construction of Ashton Asoke Condominium Project (the value of the project is around THB6.5 billion), which is considered one the most impact to the consumers in Thailand.
• Advising and representing the River Condominium juristic person in a series of complaints against the developer in connection with the transfer or handover of the common properties, construction drawings together with the rescission of the transactions entered into between the developer and third parties for a claim amount of THB1.4 billion.
• Advising a Thai company in connection with a water supply concession dispute with a local administrative office for more than THB500 million damages.
• Advising SEB Kort Bank and Diners Club Nordic in connection with business rehabilitation proceedings under Thai bankruptcy law of Thai Airways.
