Introduction

Pravin Anand is the managing partner and head of litigation at Anand and Anand.

Awarded the AIPPI Award of Merit, INTA’s President’s Award, recognised as the Most Innovative Lawyer by the Financial Times and the first Indian to be inducted in the IAM IP Hall of Fame, he has appeared in more than 3,000 cases and successfully established hundreds of landmarks during 43 years of practice as an IP lawyer.

Pravin has strengthened India’s IP jurisprudence with a practice encompassing all facets of the field.

To his credit are patent lawsuits that have transformed the pharmaceutical and biotechnology enforcement regime in India, including Merck v Glenmark (the first patent lawsuit to be decided in the plaintiff’s favour post-trial under the Patents Act); Roche v Cipla; the Monsanto case; and a large number of other suits on behalf of Pfizer, BMS, AstraZeneca, etc.

Pravin has broken new ground in Indian IP jurisprudence with the country’s first pro-tem security order, in favour of Nokia, India’s first anti-anti-suit injunction (InterDigital v Xiaomi); the Nokia-Lenovo multi-technology multiyear agreement; software patent lawsuit conferring protection (Ferid Allani case); development of damages culture in a large number of cases that recognised not only punitive, but compensatory, exemplary and aggravated damages (Philips v AmazeStore); India’s first post-trial SEP judgment (Philips v Bhagirathi); development of unique remedies such as the “tree planting order” (Merck case); and an order benefitting adolescent girls (Hermes case).

Pravin writes for Halsbury’s Laws of India on Intellectual Property; Famous and Well-known Marks: An International Analysis (legislative history and analyses of national laws) published by INTA; as well as penning numerous chapters in international publications including IBLJ, ABLJ, GTDT, AsiaIP and MIP.

Pravin is the chairman of the Confederation of Indian Industry’s Sub-Committee on IPR and is the chair of the National Council on IPR at the Associated Chambers of Commerce and Industry of India. In addition, he serves as the Technical Committee Member, Legal Services Sectional Committee Bureau of Indian Standards and as the honorary member to the Managing Committee PHD Chamber of Commerce and Industry.
