Introduction

Anand Pathak is a renowned legal professional with a distinguished career in advising clients on international M&A, private equity investments, arbitrations, and competition law matters in the US, Europe and India. Admitted to practice law in both the US and India, Pathak has honed his expertise through practising law in global hubs such as Brussels, London, New York, Cleveland and Palo Alto as a partner at international firm Jones Day.

Pathak attended all the European Council meetings for the adoption of the EU’s merger control regulation. He has represented clients in complex European Commission and Indian competition law investigations and merger notifications, and in the negotiation of free trade agreements. His international M&A experience includes the disposition of assets by General Motors to Hyundai, Daiichi Sankyo’s acquisition of Ranbaxy Laboratories, Warburg Pincus in its Indian investments, Tech Mahindra’s acquisition of Satyam Computer Services, Schneider Electric’s acquisition of Luminous Power, acquisitions by HCL Technologies, Rediff.com and Tech Mahindra outside India, the sale of eTouch in the US to Virtusa, and the sale of Cigniti Technologies to Coforge.

He has successfully represented clients in international arbitrations, including Daiichi Sankyo in a Singapore-based arbitration and proceedings in the Singapore Supreme Court, as well as Amazon and UpHealth in international arbitrations and Indian and US court proceedings. He is representing the government appointed board of IL&FS in the sale of IL&FS assets, several clients in competition law matters, and the government of India in investor-state investment treaty arbitrations.

Pathak was presented with the National Law Day Award in 2005 by the prime minister of India for his unique contributions in Indian corporate law and for bringing foreign investments into India. He has received several awards for M&A and competition law.

Pathak has an LLB and MA from the University of Cambridge, and an LLM and MA in economics from Yale University. He has worked at the European Court of Justice, Luxembourg and in the competition division of the European Commission’s Legal Service in Brussels. He was a member of a committee constituted by the Indian government in 2018 for reviewing Indian competition laws and was also a member of the government-appointed committee on the digital markets legislation.
