In Rakesh S Kathotia & Anr v Milton Global Ltd & Ors, a division bench of Bombay High Court held that group entities that are not signatories to an arbitration agreement may be made parties to an application for interim relief under section 9 of the Arbitration and Conciliation Act, 1996, if they are referred to in the agreement.
